This practicum on effective practices for admitting expert testimony under Daubert will provide basic principles, practical tips, and a demonstration.

A Brave New World: the Shift of Power from Agencies to the Federal Courts

In recent cases, the Supreme Court has reduced the power of administrative agencies and shifted decision-making to the federal courts. Those cases include Loper Bright Enterprises v. Raimondo (the end of Chevron deference), Garland v. Cargill (holding that ATF exceeded its statutory authority in its rule classifying a bump stock as a machinegun), Corner Post, Inc. v. Board of Governors of the Federal Reserve System (injury and the accrual of claims against the United States), West Virginia v. EPA (the major-questions doctrine), and SEC v. Jarkesy (the SEC’s imposition of administrative fines violates the Seventh Amendment right to a jury trial). In a moderated conversation, this panel will discuss how these developments in administrative law will affect federal-court litigation.
