  • Civil & Criminal Trade Secret Litigation Strategies

The panel of judges and experienced practitioners will discuss trends and litigation strategies in civil and criminal trade secret cases. They will look back at nearly four years under the Defend Trade Secrets Act, explain from both a civil and criminal perspective what happens (and what to do) when a dispute has both civil and criminal ramifications, look at the patent-trade secret intersection, and highlight potential cross-border issues of which litigators should be mindful. The online chat feature will also be available to submit questions to the panel in writing during the course of the program.

About the Panel

Magistrate Judge Jacqueline Scott Corley has served as a magistrate judge of the Northern District of California since 2011. Her experience prior to taking the bench includes private practice in civil and criminal litigation, and serving as a career law clerk to the Honorable Charles R. Breyer.

Judge Edward Davila has served as a district judge of the Northern District of California since 2011. His experience prior to taking the federal bench includes service as a Santa Clara County Superior Court judge and both private practice and practice in the Santa Clara public defender’s office.

Miriam Kim is partner at Munger Tolles & Olson, where her practice emphasizes complex civil litigation and high-stakes investigations. Among other areas, her practice includes an emphasis on-trade secret matters, and she was named by the Daily Journal as a top trade secrets lawyer in 2020.

Daniel Olmos is a partner at Norton Barton & Olmos where his practice involves representing defendants in complex criminal cases, including trade-secret theft and economic espionage cases. In 2012-2013, Mr. Olmos served as a Senior Policy Advisor at the White House Domestic Policy Council.

James Pooley is an experienced trial lawyer, neutral, and diplomat who has authored the leading intellectual property treatise “Trade Secrets.” He has testified before Congress on intellectual property matters and served as Deputy Director General of the World Intellectual Property Organization from 2009-2014.

Katie Wawrzyniak is an Assistant U.S. Attorney and Co-Chief of the General Crimes Unit for the Northern District of California.  In 2020, she was recognized as one of the Daily Journal’s Top Trade Secret Lawyers for her work on the Anthony Levandowski matter.  Prior to joining the U.S. Attorney’s Office, Ms. Wawrzyniak spent eight years at O’Melveny & Myers LLP.
